SALES RESTRICTION

The Club’s spares operation is run on a “Not for Profit” basis and restricted to members only, for parts that will be fitted to their own cars.

As well as protecting members interests, this ensures our Mutual Trader status with the Inland Revenue which avoids any liability to pay tax other than VAT and significantly reduces the administration costs of the operation.

EXAMINATION OF GOODS

Before ordering, please check carefully that the parts requested are correct for your car and for the application.  Many Lagondas have been altered over the years and/or may have been fitted with incorrect or adapted parts, which may mean that our parts will not fit, or that they will need modification.  We cannot give full credit for parts that are returned having been damaged or marked.

On delivery, check again to ensure that the parts are correct and are what you ordered. If this is not possible it is essential to mark the Carrier’s Delivery Note “Contents Unexamined” or “Case Damaged” and then to examine the goods promptly, advising the carrier and ourselves of any shortage within 3 working days.

NON-DELIVERY OF GOODS

Customers are responsible for advising us and the Carriers of the non-delivery of goods within 20 days of our invoice, failing which no claims for shortage will be entertained by the carrier.

RETURN OF GOODS

If we have correctly supplied the goods ordered, they may be returned to us (carriage paid) for credit.  Credit will be for the invoice price, inclusive of VAT, but excluding carriage, and there will be a charge of £10 or 10% of the invoice price (whichever is the greater) for re-stocking.

If we have supplied goods incorrectly, full credit for the invoice price will be given, including VAT and carriage, plus the cost of return carriage.

Full credit will only be given on goods that are in as-new condition, and that are returned within six months from purchase.  These credit arrangements for returned goods are only available to members of the Lagonda Club.

LIABILITY FOR DEFECTIVE GOODS

In the event of any goods supplied proving to be defective in material or workmanship within one year from purchase, we will replace or repair (at our option) the goods free of charge (including carriage costs).  This shall be the limit of our liability, and we will not accept liability for any other costs, direct or indirect, arising from the fitting of any such parts or from the use of such goods.

APPLICATION

Goods are supplied only for their specific application and to fulfil the purpose for which they were designed.   No liability is accepted if goods have been misapplied.

SPECIFICATION

We are always seeking to improve our products and we reserve the right to modify or amend the specification of any of them, without notice.

RESERVATION OF TITLE

The title to goods or services supplied shall not pass to the customer until full payment has been made.  In the event of non or part-payment, we or our agent shall be entitled, without the need for any court judgment, to repossess or trace and recover the goods or the proceeds of sale from the customer, liquidator or receiver.
